The Provisions on the Technical Management of Road Transport Vehicles, as adopted at the first executive meeting of the Ministry of Transport on January 14, 2016, are hereby issued and shall come into force on March 1, 2016.

Regulations on Technical Management of Road Transport Vehicles
Chapter I General Provisions
Article 1 In order to strengthen the technical management of road transport vehicles, maintain good technical conditions of vehicles, ensure transportation safety, give full play to vehicle efficiency, and promote energy conservation and emission reduction, in accordance with the "the People's Republic of China Safety Production Law", "the People's Republic of China Energy Conservation Law", "the People's Republic of China Road Transport Regulations" And other laws and administrative regulations, formulate these regulations.
Article 2 The technical management of road transport vehicles shall be governed by these Provisions.
The road transport vehicles mentioned in these Provisions include road passenger transport vehicles (hereinafter referred to as passenger cars), road general cargo transport vehicles (hereinafter referred to as trucks), and road dangerous goods transport vehicles (hereinafter referred to as dangerous goods transport vehicles).
The technical management of road transport vehicles referred to in these Provisions refers to the technical management of road transport vehicles in terms of ensuring compliance with the specified technical conditions and carrying out maintenance, repair and comprehensive performance testing as required.
Article 3 The technical management of road transport vehicles shall adhere to the principles of classified management, prevention first, safety and high efficiency, energy conservation and environmental protection.
Article 4 Road transport operators are the main body responsible for the technical management of road transport vehicles, and are responsible for the selection, correct use, periodic maintenance, repair as appropriate, regular testing and timely updating of road transport vehicles, so as to ensure that the vehicles put into road transport operation meet the technical requirements.
Article 5 encourage road transport operators to use safe, energy-saving and environment-friendly vehicles, promote the promotion and application of standardized vehicles, strengthen the application of science and technology, and constantly improve the management and technical level of vehicles.
Article 6 The Ministry of Transport shall be in charge of the technical management and supervision of road transport vehicles throughout the country.
The competent transportation departments of the local people's governments at or above the county level shall be responsible for the technical management and supervision of road transport vehicles within their respective administrative areas.
Road transport management institutions at or above the county level shall implement the technical management and supervision of road transport vehicles.
Chapter II Basic Technical Conditions for Vehicles
Article 7 Vehicles engaged in road transport operations shall meet the following technical requirements:
The outline dimension, axle load and maximum allowable total mass of (I) vehicles shall meet the requirements of Limits for Outline Dimension, Axle Load and Mass of Road Vehicles (GB 1589);
The technical performance of (II) vehicles shall meet the requirements of "Road Transport Vehicles Comprehensive Performance Requirements and Test Methods" (GB 18565);
The fuel consumption limits of (III) models shall meet the requirements of Limits and Measurement Methods for Fuel Consumption of Commercial Buses (JT 711) and Limits and Measurement Methods for Fuel Consumption of Commercial Trucks (JT 719).
The technical grade of (IV) vehicles shall reach two or more. Dangerous cargo transport vehicles, international road transport vehicles, passenger cars engaged in highway passenger transport, and passenger cars with a length of more than 800 kilometers in operation shall have a technical level of one. The method of technical grade assessment shall meet the requirements of the State for the classification and assessment of the technical grade of road transport vehicles;
(V) engaged in highway passenger transport, chartered passenger transport, international road passenger transport, and the operating line length of more than 800 kilometers of passenger cars should reach the intermediate level or above. Its type classification and rating shall meet the national requirements for the classification and rating of operating passenger cars;
(VI) dangerous goods transport vehicles shall comply with the requirements of the Regulations on the Carriage of Dangerous Goods by Motor Vehicles (JT 617).
Article 8 The road transport management agency shall strengthen the management of vehicles engaged in road transport operations, and shall not issue road transport certificates to vehicles that do not comply with these regulations.
When the trailer is issued with a road transport certificate and annual inspection, it shall be checked whether the trailer has a valid driving certificate.
Article 9 It is forbidden to use scrapped, unauthorized modification, assembly, unqualified testing and other vehicles that do not meet the requirements of the State to engage in road transport business activities.
Chapter III General Requirements for Technology Management
Article 10 Road transport operators shall abide by relevant laws, regulations, standards and norms, earnestly perform the main responsibility of vehicle technical management, establish and improve the management system, and strengthen vehicle technical management.
Article 11 road transport operators are encouraged to set up corresponding departments to be responsible for vehicle technical management, and to equip vehicle technical management personnel according to the number of vehicles and business categories to implement effective technical management of vehicles.
Article 12 Road transport operators shall strengthen business training in vehicle maintenance, use, safety and energy conservation, improve the professional quality and skills of employees, and ensure that vehicles are in good technical condition.
Article 13 Road transport operators shall use vehicles correctly in accordance with the relevant road transport enterprise vehicle technical management standards, combined with the vehicle technical status and operating conditions.
Encourage road transport operators to formulate technical management specifications for vehicle use in accordance with relevant standards, scientifically set vehicle economic and technical quota indicators and conduct regular assessments to improve vehicle technical management.
Article 14 A road transport operator shall establish a vehicle technical file system and implement one vehicle for one gear. The contents of the file shall mainly include: basic information of the vehicle, vehicle technical grade evaluation, passenger car type grade evaluation or annual type grade evaluation review, vehicle maintenance and repair (including the "Certificate of Completion and Delivery of Motor Vehicle Maintenance"), replacement of main parts of the vehicle, vehicle changes, mileage, traffic accidents causing damage to the vehicle, etc. The contents of the archives shall be accurate and detailed.
When the ownership of the vehicle is transferred or transferred, the technical files of the vehicle shall be handed over with the vehicle.
Road transport operators shall use information technology to do a good job in the management of technical archives of road transport vehicles.
Chapter IV Vehicle Maintenance and Repair
Article 15 A road transport operator shall establish a vehicle maintenance system.
Vehicle maintenance is divided into routine maintenance, primary maintenance and secondary maintenance. Routine maintenance is carried out by the driver, and primary maintenance and secondary maintenance are organized and implemented by the road transport operator, and records are made.
Article 16 Road transport operators shall, in accordance with relevant national standards, vehicle maintenance manuals, operating instructions, etc., combined with vehicle types, vehicle operating conditions, mileage, road conditions, service life and other factors, determine the vehicle maintenance cycle by themselves to ensure the normal maintenance of vehicles.
Vehicle maintenance work items shall be determined in accordance with the technical specifications of the State on vehicle maintenance.
Road transport operators can carry out secondary maintenance operations on their own vehicles to ensure that the vehicles put into operation meet the technical management requirements, without the need for secondary maintenance completion quality inspection.
If a road transport operator does not have the ability to perform secondary maintenance operations, it may entrust a motor vehicle maintenance operator of Class II or above to perform secondary maintenance operations. After completing the secondary maintenance operation, the motor vehicle maintenance operator shall issue the secondary maintenance factory certificate to the entrusting party.
Article 17 Road transport operators shall follow the principle of case-based repair and make timely repairs to vehicles according to the actual situation.
Article 18 The special vehicles and tank-type special vehicles (including tank trailers) used by road transport operators for the transportation of highly toxic chemicals and explosives shall be repaired by enterprises with road dangerous goods transportation vehicle maintenance qualifications.
The tractors of special vehicles and other vehicles for the transport of dangerous goods as stipulated in the preceding paragraph can be repaired by enterprises with general vehicle maintenance qualifications after the road transport operators have eliminated the hazards of dangerous goods.
Chapter V Management of Vehicle Inspection
Article 19 A road transport operator shall regularly go to a motor vehicle comprehensive performance testing institution to conduct comprehensive performance testing on road transport vehicles.
Article 20 A road transport operator shall, starting from the month when a road transport vehicle first obtains the Road Transport Certificate, entrust an automobile comprehensive performance testing agency to conduct comprehensive performance testing and technical grade evaluation in accordance with the following cycles and frequencies:
(I) passenger cars and dangerous goods transport vehicles shall be tested and evaluated once every 12 months if they have been registered by the national motor vehicle registration department for less than 60 months for the first time; if they are more than 60 months, they shall be tested and evaluated once every 6 months.
(II) other transport vehicles that have been registered with the national motor vehicle registration authority for the first time shall be tested and evaluated once every 12 months.
Article 21 The comprehensive performance testing of passenger cars and dangerous goods transport vehicles shall be entrusted to the automobile comprehensive performance testing agency where the vehicle is registered.
The comprehensive performance testing of trucks can be entrusted to the comprehensive performance testing agency of the local vehicles.
Article 22 Road transport operators shall choose testing institutions that have passed the measurement certification of the quality and technical supervision department, obtained the measurement certification certificate and met the "General Requirements for the Capability of Automobile Comprehensive Performance Testing Stations" (GB 17993) and other relevant national standards to conduct vehicles Comprehensive performance testing.
Article 23 The vehicle comprehensive performance testing agency shall compare the vehicles newly entering the road transport market in accordance with the "Road Transport Vehicle Fuel Consumption Standard Model Table. For new and in-use vehicles that meet the standards, testing and evaluation shall be carried out in accordance with "Comprehensive Performance Requirements and Inspection Methods for Road Transport Vehicles" (GB 18565) and "Technical Grade Classification and Evaluation Requirements for Road Transport Vehicles" (JT/T 198), and a national unified comprehensive performance test report for road transport vehicles shall be issued, the technical grade of the vehicles shall be evaluated, and marked on the report sheet. The road transport administrative agency at or above the county level where the vehicle is registered shall indicate the technical grade of the vehicle on the Road Transport Certificate.
The automobile comprehensive performance testing institution shall ensure that the testing and evaluation results are objective, fair and accurate, and bear legal responsibility for the testing and evaluation results.
Article 24 The road transport management agency and the automobile comprehensive performance testing agency entrusted by it to undertake the passenger car type rating work shall conduct the passenger car type rating or annual type rating review in accordance with the "Passenger Car Type Classification and Rating" (JT/T 325), and issue a unified type of passenger car type rating report.
Article 25 A vehicle comprehensive performance testing institution shall establish a vehicle testing file, which mainly includes: vehicle comprehensive performance testing report (including vehicle basic information and vehicle technical grade), and passenger car type rating record.
The storage period of vehicle inspection files shall not be less than two years.
Chapter VI Supervision and Inspection
Article 26 The road transport management agency shall supervise and inspect the technical management of road transport vehicles in accordance with its duties and powers.
Road transport operators shall cooperate with the supervision and inspection of road transport management institutions, truthfully report the situation and provide relevant information.
Article 27 The road transport management agency shall incorporate the technical conditions of the vehicles into the annual inspection of road transport vehicles, and check the following corresponding certification materials:
Technical rating conclusion of (I) vehicles;
(II) bus type rating certificate.
28th road transport management agencies should establish a vehicle management file system. The contents of the file mainly include: basic information of vehicles, vehicle technical rating, bus type rating or annual type rating review, vehicle changes and other records.
Article 29 The road transport administrative agency shall incorporate the technical management of transport vehicles into the quality credit assessment and integrity management system of road transport enterprises.
Article 30 The road transport management agency shall actively promote the use of modern information technology, and gradually realize the sharing of road transport vehicle technology management information resources.
Chapter VII Legal Liability
Article 31 In violation of these regulations, if a road transport operator commits one of the following acts, the road transport management agency at or above the county level shall order corrections and give a warning; if the circumstances are serious, a fine of 1000 yuan up to 5000 yuan shall be imposed:
The technical conditions of (I) road transport vehicles fail to meet the requirements and inspection methods for comprehensive performance of road transport vehicles (GB18565);
(II) the use of scrapped, unauthorized modification, assembly, unqualified testing and other vehicles that do not meet the requirements of the state to engage in road transport business activities;
The (III) fails to carry out the vehicle comprehensive performance test and technical grade evaluation according to the specified cycle and frequency;
The (IV) has not established the technical archives of road transport vehicles or the archives do not conform to the provisions;
(V) vehicle maintenance records are not made.
Article 32 In violation of these regulations, if a road transport vehicle comprehensive performance testing agency commits one of the following acts, the road transport management agency at or above the county level shall not accept its test report and report a copy to the quality and technical supervision department at the same level for handling.
The (I) does not test the road transport vehicles according to the technical specifications;
The (II) has not issued the test results of road transport vehicles;
The (III) fails to provide the test results truthfully.
Article 33 Any staff member of the road transport management agency who abuses his power, neglects his duty, or engages in malpractices for personal gain in the supervision and management work shall be given administrative sanctions according to law; if a crime is constituted, it shall be dealt with by the judicial organ according to law.
Chapter VIII Supplementary Provisions
Article 34 These Provisions shall come into force as of March 1, 2016. The "Regulations on the Technical Management of Vehicles in the Automobile Transport Industry" (Order No. 13 of 1990 of the Ministry of Communications) and the "Regulations on the Maintenance and Management of Road Transport Vehicles" (Order No. 4 of 2001 of the Ministry of Communications) issued by the former Ministry of Communications shall be repealed at the same time.
